These terms govern the use of Omoidetabi and the purchase of its paid plans and, once available, of printed books. The service is provided by [COMPLETAR: nombre y apellidos o razón social del titular] (full details in the legal notice). By creating an account you accept these terms and confirm you have read the privacy policy.

1. Your account

  • You must be at least 14 years old. To buy paid plans or printed books you must be of legal age or have the permission of your parents or guardians.
  • The details you give us must be true. The account is personal: keep your password secret and tell us if you suspect unauthorized use. You are responsible for what is done from your account.
  • You can delete your account whenever you want in Settings → Data & account. Your books and files are deleted right away and your subscription is canceled (see section 6 about refunds).

2. The service

Omoidetabi lets you create digital memory books with photos, videos, text, maps and audio, view them as a 3D book, share them, collaborate with other people, use an AI writing assistant and order printed books. There is a free plan with limits and paid plans with more capacity and features; what each plan includes is described on the pricing page at the time of purchase.

New features we announce are only part of what you pay for once they are available. We may improve or change the service; if a change significantly reduces what you pay for, we will tell you in advance and you will be able to cancel.

We make backups, but Omoidetabi is not a replacement for your own copy: keep the originals of your photos. You can download your data at any time.

3. Your content and the licence you give us

The books, photos, texts and audio you upload are yours. So that we can provide the service, you grant us a non-exclusive, free, worldwide and limited licence to store them, reproduce them, adapt them technically (for example, generating thumbnails or optimized versions) and show them to the people you choose: only you, your collaborators, whoever has the link or the public if you publish them. If you order a printed book, the licence includes sending it to print.

The licence ends when you delete the content or your account, except for backups during their retention period and for what other people added to their own books as collaborators. We don't use your content for advertising and we don't sell it.

You guarantee that you hold the necessary rights over what you upload: that the photos and texts are yours or you have permission, that you have the consent of the people who appear in them (especially minors) and that you have a licence for any music you add as background.

4. Prohibited content and uses

You may not upload, share or link to content that:

  • is illegal or promotes illegal activities;
  • shows child sexual abuse, nudity or sexual content of other people without their consent, or any explicit sexual content in public books;
  • incites hatred, violence, harassment or discrimination;
  • infringes copyright, trademarks or other rights of third parties;
  • discloses other people's personal data without their permission;
  • is spam, unsolicited advertising, malware or impersonation.

You also may not try to access other people's accounts, bypass the limits of your plan, extract data massively or overload the service.

Reports and moderation

If you see illegal content or content that breaks these terms, report it with the Report button on the book, page or comment (no account needed) or through the contact form (reason «Report illegal content») with the link and why you think it is illegal. If you leave your email, we will confirm we received it. A person will review every report diligently and we will tell you what we decide.

We may remove or disable content that breaks the law or these terms (unpublish a book or a page, delete a comment) and, in serious or repeated cases, suspend the account: while it is suspended you can't sign in or publish, and your public content is no longer shown. You need an account to comment. Unless the law prevents it or there is a risk, we will explain the reason and you will be able to ask us to review the decision by replying to our notice (arts. 16, 17 and 20 of Regulation (EU) 2022/2065, the Digital Services Act).

5. Shared books and collaboration

The owner of a book decides who to invite and with which permissions. Editors can add and change pages; what they upload stays in the owner's book as long as the owner keeps it, even if the editor stops collaborating or deletes their account. The owner is responsible for the content of their book.

6. Paid plans, renewal and withdrawal

  • Price: prices are shown in euros and include VAT where applicable. Payments are processed by Stripe.
  • Automatic renewal: monthly or yearly subscriptions renew and are charged automatically at the start of each period until you cancel.
  • Cancellation: you can cancel at any time from your subscription settings. You keep the plan until the end of the paid period and it won't renew. Apart from the right of withdrawal, we don't refund periods that have already started.
  • Price changes: we will tell you at least 30 days before the renewal they apply to; if you don't agree, you can cancel before then.
  • Failed payments: if a charge fails we will retry for a few days; if it isn't resolved, your account moves to the free plan. Your books are not deleted, but the limits of that plan apply.

Right of withdrawal (14 days). If you are a consumer, you can withdraw from your subscription within 14 calendar days of buying it without giving any reason (arts. 102 et seq. of the Spanish consolidated General Law for the Protection of Consumers and Users, TRLGDCU). To do so, write to [COMPLETAR: email de contacto, p. ej. hola@tudominio.com] or use the contact form (reason «Payments and subscription») with a clear statement, for example: «I hereby give notice that I withdraw from my Omoidetabi subscription contract, bought on [date], in the name of [name] and with the email [email]». We will refund the full amount within 14 days at the latest, using the same payment method, at no cost to you.

7. Printed books

Printed books are produced from the design you create, with your photos and texts. Before paying you will see a preview and the total price including taxes and shipping. Our print-on-demand provider prints and ships them, with production in the EU.

Because they are made to your specifications and clearly personalized, printed books have no right of withdrawal (art. 103.c TRLGDCU). Check the preview carefully: spelling mistakes, the quality of the photos you upload or the design you choose are not defects.

You do have the legal guarantee of conformity: if the book arrives damaged or with a printing or binding defect, send us photos and we will reprint it or refund you (arts. 114 et seq. TRLGDCU). Production and shipping times will be shown when you order.

8. Our intellectual property

The software, brand, design, templates and styles of Omoidetabi belong to us or our licensors. We allow you to use them only within the service and for your books; you may not copy them, resell them or build derivative services.

9. Liability

We provide the service with due care, but there may be interruptions due to maintenance, provider failures or causes beyond our control. We are not liable for content published by users or for indirect damage or loss of profit. Except in cases of wilful misconduct or gross negligence, our liability towards you is limited to the amount you paid us in the 12 months before the event that causes it.

Nothing above limits the rights consumer law gives you that cannot be excluded.

10. Suspension and closing the account

We may suspend or close an account that seriously breaches these terms or the law, telling you beforehand unless it is urgent. If we close your account without you having breached anything, we will refund the unused part of the period you paid for.

11. Changes to these terms

If we change these terms significantly, we will tell you at least 15 days in advance by email or in the app and ask you to accept them when you sign in. If you don't agree, you can cancel your subscription and delete your account.

12. Governing law and complaints

These terms are governed by Spanish law. If you are a consumer, you can bring a claim before the courts of your place of residence and contact the consumer services of your region. Before that, write to us at [COMPLETAR: email de contacto, p. ej. hola@tudominio.com] and we will try to sort it out.
